Hold Terry McAuliffe Responsible for his Anti-Democratic Actions

Indiana Wind Symphony to celebrate 10 years and 100 concerts

Indiana Wind Symphony Celebrates 10 Seasons and 100 Concerts


The Indiana Wind Symphony will celebrate its 100th concert and the finale of the tenth season in a concert on Saturday May 23, 2009, 7:30 PM, at the Ben Davis High School Auditorium.



The IWS will present to Jackson Wiley the annual James B Calvert Outstanding Music Educator Award. Wiley founded the Greater Indianapolis Youth Symphony in 1970 when he became the Butler Symphony Conductor and was one of the founders of the Indianapolis Opera Company. He served as Music Director of the Indianapolis Philharmonic Orchestra and the Athenaeum Orchestra.



Tenor soloist Ken Knowles will perform Nessum dorma from “Turandot.” The IWS saxophone section will be featured on Frigyes Hidas' Concerto for Four Saxophones and Band. The IWS performed the American premier of this work in 2000, and introduced several of the composer's major works to American audiences. Also on the program will be Peter Graham's Harrison's Dream, Hounds of Spring by Alfred Reed and selections from John Williams' scores to Star Wars.

WASHINGTON, DC -- The US District Court for the District Columbia has issued a ruling that, while dismissing the plaintiff for lack of standing, did not reject the validity of his arguments challenging the Electoral College based on the Mal-Apportionment Penalty clause of the 14th Amendment.

On July 28, 2008, plaintiff Asa Gordon (Speakers Bureau page: http://gp.org/speakers/detail.php?ID=29) of the DC Statehood Green Party filed his 'Democratization of the Electoral College' civil action against the manipulation of presidential elections inherent in the malapportionment of Electoral College votes. "This, for all intent and purposes, is a profound legal victory for reform of the electoral college to reflect the popular majority will of the American electorate in future presidential elections," said Mr. Gordon.

The court issued its order (Case 1:08-cv-01 294-HHK) and memorandum opinion on March 26. The ruling dismissed Mr. Gordon as the title plaintiff in the civil action for lack of standing.

But the ruling on Gordon v. Cheney, now Gordon v. Biden, provides a blueprint for future progressive civil actions to reform the Electoral College to reflect the popular vote in presidential elections.

"I am very pleased with the ruling, but unsatisfied to the extent that I plan to appeal what I deem to be the court's error to deny me personal standing," said Asa Gordon. "The civil action was not only motivated by my personal standing as an injured voter, but the main objective was to determine the legal viability of the 14th Amendment's Mal-Apportionment Penalty clause pleaded before the court that would democratize the Electoral College. The court granted the dismissal order predicated on a memorandum opinion that did not reject the constitutional arguments I pleaded before the court."

The District Court, citing case law precedents, ruled that "a pro se plaintiff... cannot adequately represent the interests of other class members." The court granted the dismissal motion, stating: "Because Gordon's alleged injury is not 'fairly traceable' to the Vice President's actions, which in fact are purely ministerial, but rather is attributable to the actions of third-party states and state officials, he fails to satisfy the causation element of standing. Therefore, he is unable to prosecute this action."

The court's memorandum opinion observes that Mr. Gordon "filed this action on July 28, 2008, against Richard Cheney, then the Vice President of the United States ('Vice President'), in his official capacity. In anticipation of the then-upcoming presidential election and the role that the Vice-President would play in the election by presiding over and certifying the official vote count of the US Electoral College, Gordon sought by this action to prevent the Vice-President 'from presiding over the tabulation of 'unbound electoral states' who by practice, unsupported by state or federal statute, traditionally award Presidential Electors on a 'winner-take-all basis'." Mr. Gordon argued that the Vice President is the only government official who can consummate the miscounting of presidential electors.

Mr. Gordon defended his strategy and standing by noting that he represents a class of voters, having served as a presidential elector for the DC Statehood Green Party in recent elections. Furthermore, he uniquely represents a related class of voters -- those from the District of Columbia -- who have no Representative or Senator in Congress who can raise an objection when the US Senate confirms a presidential election. Thus his only recourse was to petition the federal court for a remedy.

"Civil actions like Asa Gordon's represent the best hope for a legal remedy to engineered elections and the breakdown of our democracy. Few people have shown the dedication and perseverence that Asa has. I hope that his Electoral College challenge won't end with the District Court's recent decision," said Cynthia McKinney, the Green Party's 2008 candidate for President of the United States (http://www.gp.org/cynthia/index.php).

Asa Gordon noted that Rep. John Conyers (D-Mich.), commenting on issues raised in the civil suit on December 8, 2004, said, "This is the most amazing proposition that has ever been brought forward... and if it is accurate it could change the whole outcome of the voting process in the United States, and we will take that under consideration... We, we eagerly embrace your suggestion."

"The only question that remains is whether the NAACP, ACLU, American Constitution Society, and American Bar Association will now follow the Green Party's lead on civil actions that will enforce the constitutional provision compelling the Electoral College to reflect the popular vote," added Mr. Gordon.

Greens have consistently challenged the Electoral College's validity as a reflection of the popular will in national elections. The Green Party's national platform endorses a constitutional amendment abolishing the Electoral College and providing for the direct election of the president by instant runoff voting (http://www.gp.org/platform/2004/democracy.html#309649).

The Green Party Endorses National Seeds Day

WASHINGTON, DC -- The Green Party of the United States has endorsed International Seeds Day (ISD, http://www.INEAS.org/20090426_PR.pdf) on April 26, which will mark the fifth anniversary of the passage and signing of Order 81 by Paul Bremer, administrator of the Coalition Provisional Authority in Iraq.

Order 81 (http://www.trade.gov/static/iraq_memo81.pdf) prohibits Iraqi farmers from reusing seeds harvested from new varieties introduced in Iraq and registered under the law. According to the law, farmers are banned from saving such seeds and required to pay royalties to the holder of the patent on the seed -- an American corporation. The Iraqi constitution has historically prohibited ownership of biological resources.

ISD, organized by the Institute of Near Eastern & African Studies (INEAS, http://www.INEAS.org), will educate the public and media about the importance of biodiversity and seed saving; the dangers of genetically modified food and patent seeds; the ruinous effect of Order 81 on Iraqi agriculture; and the growing resistance to the power of giant agribusinesses over seed resources.

"Order 81 has made farmers in Iraq -- who have planted since 7000 BCE -- dependent on companies like Monsanto. We call on President Obama and Congress to repeal Order 81 immediately," said Sanda Everette, permaculture designer and a co-chair of the Green Party of the United States.

"Monsanto has a record of selling pest-resistant seeds that have been genetically engineered for sterility to farmers around the world, rendering the farmers permanently dependent. Order 81 has turned Iraq into a feeding trough for favored US corporations, just as the Iraqi hydrocarbon law gives US and British oil companies control over most Iraqi oil. The US invasion and occupation of Iraq have proven to be an exercise in death and destruction for the sake of corporate pillage," said Ms. Everette.

According to INEAS, "[f]armers in Iraq have operated in a mostly free-to-little-regulated, informal seed supply system. Farm-saved seeds and the free exchange of planting materials among farmers have long been the basis of agricultural practice in Iraq. Yet all of this has become history.... The purpose of Order 81 is to facilitate the establishment of a new seed market in Iraq, one in which Iraqi farmers are forced to make their annual purchase of seeds, including those that are genetically modified, from transnational corporations."

INEAS notes that Order 81 grants US firms complete control over Iraqi farmers' seed for 20 years, requiring them to sign an agreement to pay a 'technology fee' and an annual license fee. "Plant Variety Protection (PVP) made seed reusing and saving illegal as well as 'similar' seed plantings punishable by severe fines and imprisonment. Agribusiness wants the same rights everywhere, including in the USA. This will jeopardize the future of organic and independent farming."

Similar laws have placed many developing countries in Africa and Asia, including Afghanistan and India, at the mercy of foreign agribusiness monopolies.

The Green Party supports the right of farmers to save their own seeds and preserve the heritage that farmers have developed over thousands of years to sustain human populations. Greens advocate the establishment of international seed banks such as the Svalbard Global Seed Vault in Norway.

Greens support protection for small farms, farmers' markets, and organically and locally grown produce in the US and around the world, all of which have been threatened by agribusinesses like Monsanto, Archer Daniels Midland, and Tyson. The Green Party opposes genetic modification of organisms used for food and supports legislation to protect the public from threats to biodiversity from seed stocks created by corporations.
